TERMS AND CONDITIONS

1.By subscribing to the Sexyoverforty.com service (the "site"), you become a Subscriber and agree to be bound by this Agreement (the "Agreement"). This agreement is subject to change by Sexyoverforty.com at any time, and changes are effective upon notice to each current Subscriber.

2.Subscribers are responsible for providing all personal computer and communications equipment necessary to gain access to the Service. Access to and use of the Service is through a combination of an ID and a password. Each Subscriber must keep his or her password strictly confidential. For security reasons, Sexyoverforty.com will not release passwords for any reason, except to the original email address supplied during password selection or as may be specifically required by law.

3.Unauthorized disclosure of username and/or password directly by subscriber, indirectly by subscriber, or otherwise will result in immediate suspension of service without notification or refund of paid fees.

4.Subscriber assumes all liability of using the Site including without limitation any failure of performance, error, omission, interruption, deletion, defect, delay in operation or transmission, communications line failure, theft or destruction or unauthorized access to, alteration of, or use of records, whether for breach of contract, tortous behavior, negligence, or under any other cause or action.

5.No warranty is made by Sexyoverforty.com regarding any information, services, or products provided through or in connection with the Service, and Sexyoverforty.com and hereby expressly disclaims any and all warranties, including without limitation:1) any warranties as to the availability, accuracy, or content of information, products, or services; 2) any warranties of merchantability or fitness for a particular purpose.

6.The material on the Site is for the private, non-commercial enjoyment of Subscribers only. Any other use is strictly prohibited.

7.Material on the site must not be made available to any other person or persons in any form either directly or indirectly.

8.Notices by Sexyoverforty.com to Subscribers may be given by means of electronic messages through the Site, by a general posting on the service. Notices by Subscribers may be given by electronic messages, unless otherwise specified in the Agreement.

9.All questions regarding Sexyoverforty.com subscriptions should be sent by means of electronic message to help@Sexyoverforty.com unless otherwise stated in response emails from the Site. Please include your name and username in all correspondence.

10.The subscriber hereby warrants and represents that he or she is over the age of 18, and in all respects is qualified and competent to enter into this agreement.

11.Subscriber acknowledges that he or she has also read and agreed to the statements presented to him or her on the Site's Disclaimer page.

12.Subscription fees. The subscriber is responsible for paying all subscription fees according to the billing terms at time of initial purchase. Subscription fees are non-refundable.

13.Payment for services may be made by automatic credit card debit, check or WEB900 #. Members will be automatically renewed for the original term upon expiration, unless Sexyoverforty.com is notified via email 7 days prior to membership expiration.

14.Sexyoverforty.com will have the right to refuse membership to any individual or entity. Subscription to the Site may be terminated at any time, and without cause, by either Sexyoverforty.com or the Subscriber upon notification of the other by email. When termination is requested by a member, subscription fees are NOT refunded. Subscribers are liable for charges incurred by them until termination of service.

15.Unless and until this agreement is canceled in accordance with the terms hereof, Subscriber hereby authorizes the "Site" to charge subscriber's credit card (or other approved facility) to pay for the ongoing cost of membership. Subscriber hereby further authorizes the "Site" to charge Subscriber's credit card (or other approved facility) for any and all purchases of products, services and entertainment provided by Sexyoverforty.com. Membership may not be assigned or transferred to any other person or entity.

16.This Agreement supersedes all prior written and oral understandings and writings, and may only be amended upon notice by Sexyoverforty.com to Subscribers. Unless otherwise explicitly stated, the provisions of this Agreement shall survive its terminations.
